Terms of use
The Spanish version of these terms is the binding one.
What you are buying
Cajista is proprietary software. Buying a licence gives you the right of use described here, not ownership of the program or its code. Free use is governed by these terms too, even though there is nothing to pay.
Who sells it to you
The program is made and operated by Francisco Borja Arias Medina, whose details are at the end. The sale is made by Paddle — Paddle.com Market Ltd — as the seller: they charge you, they issue the invoice, they are the name on your card statement, and their own terms apply to that purchase as well. These terms are the licence for the program, which is ours. For anything at all, refunds included, write to us at hola@cajista.com: we deal with them.
What each plan includes
- Free use. Every working feature and the export for review, with no limit on time, albums or photographs.
- Yearly plan. Unlimited export for print for twelve months from purchase, on up to three computers.
- Monthly plan. Unlimited export for print for the month paid, on up to three computers.
Renewal and cancellation
Both paid plans are subscriptions and renew on their own: the yearly one every twelve months, the monthly one every month, at the same price, until you cancel. Paddle takes the payment from the method used for the purchase. We write to the email you bought with thirty days before every expiry date, whether it is going to renew or not, and the program shows it on the licence chip.
You can cancel whenever you want, without giving a reason, from Paddle's customer portal — the link is in the email for every payment — or by writing to hola@cajista.com and we'll do it. Cancelling takes nothing away from what you already paid: the licence is valid until its expiry date, and after that the print file stops coming out. Everything else stays the same.
If the price ever goes up, we'll tell you at least thirty days before the renewal and you can cancel before it applies. An increase never affects a period already paid for.
What you may do
Use the program for your professional work, including work you invoice to your clients. The albums and files you produce are entirely yours: we claim no rights over them or over your photographs.
What you may not
- Share, resell or transfer your licence key.
- Decompile, disassemble or extract the program's code, except to the extent the law expressly permits.
- Redistribute the program, modified or not.
When we may revoke a licence
Only for what you have just read: sharing, reselling or transferring the key, or fraudulent use. Also if you charge the payment back to your bank instead of asking us for a refund, because then the licence is no longer paid for. Before revoking we write to the email you bought with and give you fourteen days to put it right, unless the fraud is plain. If we revoke without cause, we refund the part of the period you could not use.
Your data and your files
Albums are stored in your browser's storage, on your own computer. That means you are the one who has to keep them: if you clear your browser data, change computers or the system frees up space, they are gone. The program can save complete backups and you should use them. We cannot recover a lost album, because we never had it.
Refunds
Fourteen calendar days from purchase, by writing to hola@cajista.com. We do not ask you to waive your right of withdrawal in exchange for starting to use the program: you keep it in full. The refund is carried out by Paddle, who took the payment, and goes back to the same payment method. Since the free plan lets you try the whole program before paying, we recommend doing that.
Availability
Working in the program does not depend on our servers. Licence activation, print export authorisation and automatic layout do, and they may be interrupted by maintenance or incidents. We commit that an interruption will never stop you editing or exporting for review.
If the service is discontinued
Export for print asks our service for authorisation, so it is worth saying what would happen if we ever stopped maintaining it. We commit to one of two things, at our choice: releasing a version of the program that exports for print without asking anyone for permission, or refunding the proportional part of what you paid and will not be able to use. We will give at least thirty days' notice. Opening your albums, editing them, exporting them for review and saving backups do not depend on us and will keep working just the same.
Warranty and liability
We are answerable for the program doing what we say here and on the pricing page, and for maintaining it while your licence is valid. If something doesn't work as it should, write to us: we fix it, and if we can't, we refund what you paid for the affected period. If you buy as a consumer you also have the legal guarantee of conformity, and nothing below limits it.
What is out of scope: always check the files before sending them to the lab. We are not liable for the cost of a print run, for lost work, or for albums you did not back up. In professional use — when you buy as a self-employed person or a company rather than as a consumer — our total liability is limited to the amount you have paid us over the previous twelve months, except in cases of wilful misconduct or gross negligence.
Acceptance and changes
You accept these terms when you buy a licence and when you activate it in the program; if you use the free plan, by using it. Which version you accepted, and when, is recorded alongside your licence, and earlier acceptances are not erased when a new one is recorded.
If they change, we'll write to the email you bought with — the only one we have, since there are no accounts or profiles. Changes do not apply retroactively to a licence already paid for; they take effect on renewal or on your next purchase.
The provider
Cajista is operated by Francisco Borja Arias Medina, Spanish tax ID 02659960X, of Plaza Patricio Aguado, 2, 28043 Madrid, Spain.
Governing law
Spanish law. Unless consumer rules require otherwise, the courts of Madrid have jurisdiction.
